Cases arising out of car, truck and motorcycle accidents are by far the most common type of personal injury case in the Delaware Superior Court in New Castle, Kent and Sussex counties today. This is not surprising, given that every 10 seconds, someone in the United States is involved in a car accident, according to the National Highway Traffic Safety Administration (NHTSA). Generally, people who operate automobiles and other vehicles must exercise "reasonable care under the circumstances." A failure to use reasonable care is considered negligence. A person who negligently operates a vehicle will be required to pay for harm to a person or property, caused by his or her negligence. The injured party, known as the plaintiff, is required to prove that the defendant was negligent, that the negligence caused the accident, and that the accident caused the plaintiff's injuries also known as damages. If you have been involved in a motor vehicle accident, do not hesitate to seek legal counsel from a personal injury lawyer or attorney, such as the attorneys at Knepper & Stratton, who are experienced in representing injury victims of automobile, truck and motorcycle accident cases in order to best protect your interests. The laws of the state in which the accident occurs determine who pays for the personal injury damages from an automobile accident. Delaware has a No-Fault motor vehicle insurance law which pays for the medical bills and lost wages of all of the occupants of your vehicle. What this means is that if you are in a motor vehicle accident in the State of Delaware in a Delaware registered and insured motor vehicle, your own insurance company will pay your medical bills and/or lost wages as you incur the expenses. Your insurance company will pay your medical bills and or lost wages, arising out of the collision, for up to two (2) years or up to the limits of your Delaware Personal Injury Protection ( PIP ) coverage or until the insurance company sends you to a doctor of their choosing who says that you no longer require treatment and/or that you are able to work. However, in spite of the no-fault aspects of Delaware law you are still entitled to make a claim for "pain and suffering" and "bodily injury" against the person who caused the accident. This is true even if you are from a state which has "limited tort" laws or a "verbal threshold" law. The Delaware Courts have consistently ruled that out-of-state tort limitations have no effect on injuries arising from motor vehicle accidents and collisions within Delaware. No-fault auto insurance law is widely misunderstood. If you are injured in an automobile accident in Delaware, you should contact an experienced lawyer from a Delaware personal injury firm, such as the attorneys at Knepper & Stratton at (302)658-1717 or (302)736-5500, to discuss how the relevant state laws interplay. Unfortunately, many Delaware drivers ignore motor vehicle insurance requirements, cannot afford to purchase insurance, or carry insufficient insurance. Delaware uninsured motorist coverage is a form of insurance that pays you compensation for bodily injury that results from an accident with a driver who is legally responsible for the injuries, but has no liability insurance coverage. Underinsured motorist coverage pays you compensation for bodily injury that results from an accident with a driver who has liability insurance with limits that are lower than the injured party's underinsured motorist coverage limits. If you have been involved in an accident with an uninsured or underinsured driver, it is important that you contact the police and make a police report within thirty (30) days of the accident. If you fail to do so you might give up any right you may have to pursue an uninsured or underinsured claim. You should also immediately contact a Delaware lawyer at an experienced Delaware personal injury law firm, such as Knepper & Stratton at (302)658-1717 or (302)736-5500, so you do not waive valuable legal rights. If you are covered under a Delaware motor vehicle insurance policy and are involved in an accident with an unidentified "hit and run" vehicle, which caused the accident, and a police report is made within thirty (30) days of the accident you can make a claim against your uninsured coverage for your property damage, medical expenses, lost wages, bodily injury and pain and suffering. You also can make the same claims against an unidentified, "phantom", motor vehicle which causes the accident even though there was no actual physical contact between your vehicle and the other vehicle, as long as a timely police report is made.
